LATEST NEWS IN THE CASE:

NGO “Anti Corruption Action Centre” is stopping the carving of funds for treatment and rehabilitation of soldiers who participated in the anti-terrorist operation in Eastern Ukraine. The situation surrounds four purchases of the State Service, who takes care of soldiers of the ATO, that took place from May through December of 2015.

BOTTOM LINE:

In particular, the State Service of Ukraine for war veterans and members of the anti-terrorist operation, in May of 2015, launched the procurement of (25 lots) worth 22.45 million UAH. As a result of bidding, on 17.08.2015 a contract was signed with one company for 1.71 million UAH and on 12.08.2015 – nine transactions totaling more than 17 million UAH.

In July of 2015, the State announced a new procurement procedure for the provision of psychological rehabilitation for affected members of the anti-terrorist operation (116 lots) with an expected valued of 49.99 UAH. The purchase contained 116 lots but only 2 were used.

In particular, an agreement was reached with “South-Resort-Service” at the sanatorium “Orizont” (5,184 UAH/ticket) worth 6.73 million UAH and “Clinical Sanatorium “Kurort Berezovskaya Mineral Water” (5,250 UAH/ticket) worth 8.92 million UAH. In addition to the winners, there were six other participants in the auction, who offered much cheaper services – from 896 to 4968 UAH/ticket. However, the proposals were rejected because of far-fetched reasons.

In September of 2015, the State Service for ATO veterans reconsidered the purchase of 114 lots worth 34.33 million UAH. As a result of the procurement procedure, the competitive bidding committee, on 10.11.2015, signed agreements with LLC “Sanatorium “Feofania” in the amount of 7.57 million UAH (cost of one ticket: 5050) and Mena sanatorium “Ostrech” worth 6.51 million UAH (cost of one ticket: 5210). During these transactions there were also a number of violations, described in our statement.

In December of 2015, the State Service concluded a number of contracts for services of psychological rehabilitation for affected participants of the ATO worth 28.85 million UAH. However, according to channel “24”, the rehabilitation services provided to the injured soldiers was poor and inefficient.

In particular, LLC “Tuskavetsinvest” was supposed to provide services for 1250 ATO participants for a cost of 7.16 million UAH at the sanatorium “Geneva” in Truskavets. Soldiers were offered two weeks of rehabilitation in the sanatorium, which included consultations by doctors, visiting the sports complex, pools, consuming mineral waters, excursions and more. The “Geneva” sanatorium gave one of their buildings for the ATO soldiers, which has about 175 rooms. However, some rooms lacked adequate living condition, namely: no water, dirty towels were provided, and malnutrition was present, etc. Psychological rehabilitation included 17 psychologists, who came in three trips. Most of them worked on a volunteer basis, while funds to pay for their services were received by the sanatorium instead.

There is another question about another tender winner. The Ministry of Social Policy is suing “Sanatorium “Kyiv-Plus” for 1.5m UAH because of improper performance of the agreement on rehabilitation of people affected by the Chоrnobyl disaster. Despite this, this State Service, concerning the matters of the ATO soldiers, signed a contract with “Sanatorium “Kyiv-Plus” in excess of 1.6m UAH.

LEGAL ASPECTS OF THE CASE:

These circumstances may indicate inefficient use of funds by the State Service for war veterans and soldiers of the ATO. Therefore, we:

  1. APPEALED to the Chairwoman of the State Audit Service, Havrylova, L.V.
  2. Together with MP Serhiy Leschchenko, APPEALED to the Minister of Social Policy of Ukraine, Rozenko, P.V.
