LATEST NEWS IN THE CASE:
The “Anti Corruption Action Centre” team has collected important materials for criminal proceedings, which featured the former Chairman of “South-Western Railway”, Olexiy Kryvopishyn, who with state funds built a private sports and recreation complex called “Olympic Village”. Moreover, as shown by journalists on the television program “Our Money”, the construction was done by railway staff and even conducted on territory that belonged to the state.
In light of this we appealed to the Security Service and the Prosecutor General’s Office to investigate the fraud involving Kryvopishyn. In the end, a criminal proceeding was opened under case №22015000000000033. The Pre-Trial Investigation is being conducted by the Central Investigation Department of the MIA. However, the investigation is progressing sluggishly as until now, a suspect hasn’t been reported.
In February of 2016 it was reported that the head of the Kyiv City Administration, Vitali Klitschko, appointed Kryvopishyn, who is involved in many corruption scandals, as his advisor.
THE BOTTOM LINE:
The VIP sports club was built on 11 hectares of land in the village Hodosiivka near Kyiv. In the past, this place was a recreation center owned by the state enterprise “Ukrainian Centre for Passenger Service in Rail Transport” (UCPRT). In March 2010, the state liquidated “UCPRT” and the assets were acquired by the same name of the Joint Stock Company “UCPRT”.
The first chairman of the new “UCPRT” was Kryvopishyn, which now has 70% of its assets owned by LLC “Solid-Active”. The owners of this company were Kryvopishyn’s wife, Luba Belova and daughter Maria. Obviously, Kryvopishyn used his official position for the tasty privatization of state-owned property.
Already in 2004, CJSC “UCPRT”, with the Kyiv Regional State Administration, concluded a lease on the land where the recreation center is located for a term of 49 years. During that same year, the construction of the elite club began. In spite of the fact that on paper the construction was done by a private company controlled by Kryvopishyn, according to the testimony of railroad workers, employees of the “South-Western Railroad” were working on the site and using state funds and materials for the construction.
In particular, a memo from a foreman mentions 44 cars (3092 tons) of gravel being unloaded from July until December of 2004 from a subdivision of the “South-Western Railroad” at the construction site of the future recreational complex. Olexandr Mykolyuk, the current head of management of railroad builders, told reporters that all the gravel used to build the private complex was simply written off by the railroad. According to the builder, the railroad worked for years on the private complex owned by his boss.
Although the leisure complex has long been in operation, construction and repairs continue. Wasted materials are written off to the railroad or charitable assistance. One example happened in 2014, when the “South-Western Railroad” allegedly provided assistance to the Kyiv-Pechersk Lavra, “buying” the monks a lawn irrigation system for 1,750,000 UAH. As it turns out, the irrigation system was installed in the “Olympic Village”.
LEGAL ASPECTS OF THE CASE:
In light of the foregoing information, along with MP Serhiy Leshchenko, we:
- Appealed to the Chairman of the SBU, Nalyvaychenko V.A., with a request to include the above facts as part of the current criminal proceedings. Acting Chairman, V. Hrycak, in a letter dated 06.25.2015, pointed out that the Main Investigation Department of the SBU carried out pre-trial investigations under criminal proceedings case №22015000000000033, based on the facts that state officials of DTGO “South-Western Railway” took state funds in the amount of 1.15 million UAH while performing construction services on projects of the private sports complex “Olympic Village” from July-December of 2014, for the crime indicated in Chapter 5, Article 191 of the Criminal Code of Ukraine. On 03.30.2015, the Prosecutor General of Ukraine’s investigative jurisdiction stated that the decision of the criminal proceedings lies with the Main Investigation Department of the MIA of Ukraine. Deputy Minister Pascal V. stated that preliminary investigations were carried out by the senior investigator for particularly important cases of the Main Investigative Department of the MIA of Ukraine, Shevchyshen Artem Viktorovich. Prosecutor of Ukraine, Natalia A. Buryak, will conduct supervision of the Investigative Department concerning procedural guidelines of the criminal proceedings in the sphere of transport.
- Appealed to the Prosecutor General V.M. Shokin with a similar request, which was passed to the Prosecutor’s Office of Kyiv. The latter, represented by acting attorney A. Valendyuk, reported that the appeal was sent to the Office of the Internal Affairs of Ukraine of the South-Western Railway and the State Financial Inspection of Ukraine. The SFI of Kyiv stated that the issue of financial assistance to the Holy Domitian of the Kyiv-Pechersk Lavra was being studied during the audit of materials that were submitted to the GUS MIA of Ukraine. The question surrounding the misuse of gravel for the construction of the sports complex “Olympic Village” will be explored as part of the planned revision. As of 08.12.2015, Derzhfininspektsiya in Kyiv reported on the audits. Derzhfininspektsiya in Kyiv, based on the results of the audit, stated a number of facts that might indicate signs of committed criminal offenses. We will send the results to the audit investigator. The Kyiv construction and installation maintenance management department #1 of the South-Western Railway provided additional facts concerning A. Kryvopishyn’s abuse of office for his own benefit. Ukraine’s MIA, concerning the South-Western Railway, in a letter stated that the materials and information provided are legalized and attached to the current criminal proceeding file #22015000000000033. The pre-trial investigation is being carried out by the GUS Department of the MIA of Ukraine.
- We asked about the details of the preliminary investigation. The head of the main investigation department of the MIA A.F. Vakulenko, in a letter-dated 01.09.2015, reported that the pre-trial investigation is ongoing. A suspect has not been reported and the investigative jurisdiction of the criminal proceedings is unchanged.
