The “Anti Corruption Action Centre” team demands the punishment of those responsible for allowing the sale of apartments that were intended for employees of the Interior Ministry, including soldiers involved in the Anti Terrorist Operation (ATO). Thus, we asked the Kyiv Mayor, Vitali Klitschko and Interior Minister Arsen Avakov to give us an explanation.

THE BOTTOM LINE

As the story goes in the television program by “Our Money” on the channel ZIK, the corporation “Ukrbud” is selling apartments in the residential complex “Verhovyna” on Victory Avenue in the capital city on land which was allocated for the construction of housing for the Interior Ministry, particularly participants of the ATO.

In the transcript of the city council session on November 20th, 2014, Chairman of the Land Commission, Volodymyr Prokopiv stated: “The commission received letters of obligation from the client that the buildings in the residential area were only for housing personnel of the MIA, including those involved in the ATO. There is a letter of guarantee from the client, where they determine there will be no percentage transferred and they ensure the transfer of 100% of the premises to be built for personnel participants of the ATO”.

Deputies of the Kyiv City Council wanted to record this information in the draft decision, but indicated that Prokopiv rejected the offer, noting that the letter of guarantee from the customer – The Ministry of Internal Affairs – is enough.

MIA selected contractor, LLC “Ukrbud Development”, part of the corporation “Ukrbud”. Later it became known that over 91% of the residential area complex will be received by “Ukrbud” and not MIA personnel or ATO soldiers.

Journalists appealed to the developer, asking it to answer if it was true that all apartments will be given to ATO soldiers. However, the developer stated that there is no guarantee letter: “…We tried to find this letter, but there simply isn’t one. It was information for consideration and nothing more. Concerning the current building, there is no general act that these apartments will be transferred to ATO soldiers”.

In addition, the corporation “Ukrbud” is only a state enterprise on paper. The structure of the corporation includes dozens of companies and the percentage that the state owns is of little value. The major firms that act as builders, investors, and developers are private. Thus, Espedzho Giancarlo and Jorge Castillo of Belize own LLC “Ukrbud Development”, which drives LCD “Verkhovyna”.

LEGAL ASPECTS OF THE CASE:

Given the above, together with MP Serhiy Leshchenko, we:

  1. Addressed the Chairman of the Kyiv City Council, Vitali Klitschko, with a request to inform us whether or not there is a letter of guarantee provided by the MIA to the Kyiv City Council, which cited a promise to grant the constructed housing units to soldiers of the ATO.
  2. Appealed to the Head of the Ministry of Internal Affairs, Arsen Avakov, to provide information on the construction of housing for departmental employees of the MIA, particularly where the agency acted as a client of the building during 2014-2015.
